These Terms of Services (“Terms”) constitute the entire understanding and agreement between the Client (“the Client”) and Pocket Change Fashion LLC and its affiliates (“Pocket Change”) relating to the purchase of the garment alterations (the “Services”) and supersedes and replaces any and all prior agreements, whether written or oral, that may exist between them with respect thereto.

I. Payment. We’re confident that you will be thrilled with your alteration. We understand, however, that sometimes an alteration may not be what you expected it to be. In that unlikely event, we invite you to review the following terms related to refunds, returns, and subsequent alterations to correct original alterations.

Because each garment is subjectively tailored, we do not offer any refunds or credit for any alterations that have been performed by Pocket Change regardless of the client’s level of satisfaction. The client agrees that under no circumstance will the Company be required to reimburse client for any garment(s) or replace such garment(s) that the client deems to be damaged by Pocket Change, even if said client deems the garment(s) to be damaged beyond repair. By voluntarily providing payment details to the Company, the client agrees to all terms and conditions set forth, herein, which includes but is not limited to, that that the client explicitly understands that once an order is placed and a garment is received, that work on the garment(s) generally commences shortly thereafter, expenses are incurred by the Company as part of its operations and quality of work is subjective.

When Pocket Change and a customer commence a business relationship (at the time of the initial sale when payment information is provided to Pocket Change) whereby Pocket Change performs an alteration service in exchange for payment, the customer clearly understands that there is a risk associated with tailoring a garment, since tailoring a garment involves subjective work and there is no objective way to measure the quality and satisfaction related to an alteration, from start to finish. The customer understands that Pocket Change may alter and/or tailor a garment such that the customer could be unhappy with the final result for a variety of reasons, including but not limited to: the resulting garment (following an alteration) is deemed unalterable, damaged or unfixable. In any of these aforementioned events, Pocket Change will not provide a refund or credit under any circumstance. In the event that a garment is deemed unalterable, defective or damaged by a customer following Pocket Change’s work on a garment, Pocket Change will not provide a refund or credit and will not replace the garment or compensate the customer for the replacement cost or re-sale value of the garment. However, in the event of an unfavorable situation, the Company will make best faith efforts (at its sole discretion) to try to remedy it. If you are unhappy for any reason, we are 100% committed to working with you to achieve a solution.


II. Acceptance. Pocket Change will begin to perform the Services upon receiving the garment and payment in full. Pocket Change cannot be held responsible for dresses that do not fit properly due to weight loss or gain, pregnancy, surgery, failure to wear the same shoes or undergarments, etc. Clients are advised to not introduce any major lifestyle changes that may influence body weight and type.

Pocket Change will execute the tailoring work. If a seam cannot be opened or sewn, or if any alteration technique is deemed high-risk the garment will be mailed back to the Client at the client’s expense and a refund or credit will be issued minus shipping charges. Some garments may be unalterable. Techniques and approaches are taken at the discretion of Pocket Change. The client expresses acknowledgment that altering a dress is a deliberate modification to the dress, and not all alterations can be undone.

All concerns or complaints are to be addressed with Pocket Change. In the event of a disagreement, any resolutions will be at the discretion and sole responsibility of Pocket Change. Pocket Change is not liable for the fit or finish work of the garment.

III. Delivery. Acceptance of and satisfaction with the Services shall automatically be deemed to have occurred upon the earlier of Client or surrogate receipt of garment.

Once the dress leaves Pocket Change’s possession, the store and the tailors are not held responsible. This includes, but is not limited to wrinkling, stains, tearing from shipping, etc. Pocket Change cannot be held responsible for fit and wear once the garment leaves the premises. Deliveries are interpreted as acceptance.

IV. Warranty Disclaimer. The Client acknowledges Pocket Change makes no guarantee as to the fit of any garments before or after services are performed. Unless otherwise expressly provided herein, all services are provided as-is, and Pocket Change hereby disclaims any and all representations and warranties, express or implied, including without limitation the warranty of merchantability, and fitness of a particular purpose.

V. Limitation of Liability. In no event will Pocket Change be held liable for any indirect, incidental, special, punitive, consequential, exemplary, or similar damages including without limitation, lost profits, loss of use, pain and suffering, or mental anguish, related to or arising out of the Services provided. In no event will Pocket Change be held liable for any direct damages related to or arising out of the services in excess of the price paid by the Client for the service which is the subject of the claim. Pocket Change shall assume no responsibility, whatsoever, for any damages caused to members or third parties as a result of the stoppage of services to a member to whom any of the previous provisions apply.

VI. Force Majeure. Any delay or failure in the performance by Pocket Change shall be excused if and to the extent caused by the occurrence of a Force Majeure. Force Majeure shall mean a cause or event that is not reasonably caused by or under the control of Pocket Change, including acts of God, fires, floods, explosions, riots, wars, hurricanes, terrorism, health emergencies or pandemics, vandalism, governmental acts, injunctions, labor strikes, and errors or omissions of a manufacturer or its distributor.

VII. Right of Refusal. Pocket Change, affiliates, and contracted agents reserve the right to refuse alteration services or sales to any individual under any circumstances at any time. Orders may be cancelled at the discretion of Pocket Change.

VII. Website Content. Information provided on this website is for information purposes only. It is believed to be reliable, but we do not warrant its completeness, timeliness, or accuracy. User and Client access uses and relies upon such content at User’s/Client’s own risk.

IX. Terms and Conditions Revisions. Pocket Change reserves the right to change these terms and conditions at any time without prior notice; Pocket Change may change, add, suspend, cancel, remove, or otherwise modify the services offered at any time without prior notice. Any such modification will be effective immediately upon public posting (www.Pocket ChangeFashion.com/terms). Your continued use of our Service and this Site following any such modification constitutes your acceptance of these modified Terms.

Clients who purchase an alterations service with Pocket Change must agree to these terms and conditions to receive service with Pocket Change. The parties agree that the electronic confirmation offered at time of purchase is the same as handwritten signatures for the purposes of validity, enforceability, and admissibility. Clients who purchase a service with Pocket Change must agree to these terms and conditions to receive service with Pocket Change.

X. Process, Acceptance. We exercise utmost care in processing garments entrusted to us and use such processes which, in our opinion, are best suited to the nature and condition of each article. Nevertheless, we cannot assume responsibility for inherent weaknesses or defects in materials that are not readily apparent before processing. This applies particularly, but not exclusively, to suedes, leathers, silks, satins, double-faced fabrics, vinyl, polyurethanes, etc. Responsibility also is disclaimed for trimmings, buckles, beads, buttons, bells, and sequins. In laundering, item(s) are not inspected, therefore we will not be responsible for any claims, including shrinkage, discoloring, runs, rips, tears, or any other damage. Note that dress cleaning, pressing, and steaming may change the texture of certain fabrics and garments. Cleaning risks are assumed by the client alone.

Pocket Change is not responsible for any staining, damage, or wrinkling during delivery. This includes long-term care for dresses that are cleaned and/or preserved, as many variables outside of our control can contribute to aging and wear/tear.

Our expected timeline for completing alterations from start to finish is 1 to 2 weeks depending on our current volume. While we do our best to meet this expected timeframe, timing is subject to change (without notice) based on a range of factors that are sometimes outside of our control. Even if there is a material delay in the timeframe with respect to a client alteration, refunds, credits and/or cancelations are not permitted under any circumstance. Pocket Change (at its sole discretion) will make best faith efforts to remedy any unfavorable situations and make things right.

XI. Copyrights/Trademarks. All content and materials available on PocketChangeFashion.com, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of PocketChangeFashion.com, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by PocketChangeFashion.com.

XII. Governing Law. This website is controlled by PocketChangeFashion.com from our office located in the state of Idaho, USA. By accessing our website, you agree that the statutes and laws of Idaho will apply to all matters relating to the use of this website and the purchase of any products or services through this site.
Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts located in Idaho, USA.  You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

UNLESS OTHERWISE EXPRESSED, PocketChangeFashion.com EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
